Proposed Regulatory Revisions: Massachusetts Asbestos Regulation (310 CMR 7.15)

DEP’s Brief Explanation and Rationale for Changes:
MassDEP is proposing to amend its Asbestos Regulation (310 CMR 7.15) in two phases. In Phase 1, the Department proposes to address two narrow issues that have been raised by stakeholders:

  • A new section [310 CMR 7.15(12A)] contains specific streamlined requirements for addressing repair and replacement of underground asbestos-cement pipe owned by public and private utilities. These proposed amendments will improve regulatory certainty for the owners and operators of underground asbestos-cement pipes, result in faster and somewhat less expensive projects where this pipe needs to be repaired or replaced, and facilitate improvements in the Commonwealth’s utility infrastructure, while protecting the public and the environment from exposure to released asbestos fibers.
  • A limited set of technical corrections to the 2014 Asbestos Regulation will address questions raised through the EO 562 stakeholder input process and through MassDEP’s outreach efforts for amendments of this regulation that were promulgated in 2014.

FY2017 State Budget is in conference committee.  The House and Senate appoint three members each to a “conference committee” to reconcile the differences between the House and Senate proposals.  The conference committee will report a final compromise bill to the House and Senate for a final vote of acceptance in each branch, before being sent to the Governor.
